New York Cannabis Energy: ESCO Choice, Rates, Utilities, and OCM Efficiency Rules
New York pairs one of the country's largest adult-use cannabis markets with a retail electricity market that has been open since 1998, and it is the only state that writes lighting and dehumidification efficiency into the cannabis license itself. Any licensee served by one of the six investor-owned utilities can buy supply from a PSC-eligible Energy Service Company (ESCO) while the utility keeps delivering. What a facility pays depends less on the supplier than on where it sits: Con Edison's Zone J costs run far above the National Grid upstate zones, and the June 2026 statewide commercial average of 23.56 cents per kWh is the highest of any deregulated cannabis state.

How New York's cannabis market is structured
The Marihuana Regulation and Taxation Act, signed March 31, 2021, created the adult-use program, and licensed retail sales began December 29, 2022 [ny-ocm-ccb-release-2026-06]. The Office of Cannabis Management (OCM) writes and enforces the rules and the Cannabis Control Board (CCB) approves licenses. The older medical program, run through Registered Organizations, continues under the same office.
The license count is large and unusually diverse. As of the May 29, 2026 CCB meeting, OCM reported 2,270 adult-use licenses statewide: 260 cultivators, 247 distributors, 327 microbusinesses, 557 processors, 527 retail dispensaries, and 352 Conditional Adult-Use Retail Dispensaries, with more than 664 dispensaries open for business [ny-ocm-ccb-release-2026-06]. Two things about that list matter for anyone thinking about energy:
- The 260 cultivator figure undercounts the sites drawing grow load. The 327 microbusinesses can cultivate too, and the medical Registered Organizations grow under separate licenses, so the real number of cultivation meters in the state is higher than the headline [ny-ocm-ccb-release-2026-06].
- Cultivation licenses are tiered by canopy. A cultivator holds one license for one type (indoor, mixed-light, or outdoor) and one tier: Tier 1 up to 5,000 square feet, Tier 2 to 12,500, Tier 3 to 25,000, Tier 4 to 50,000, and Tier 5 to 100,000 [ny-9nycrr-120-3]. The tier sets both the license fee and, as covered below, the energy compliance deadline.
New York is also the only state that writes equipment efficiency into cannabis licensing. 9 NYCRR 125.1 sets minimum lighting efficacy, dehumidification efficiency, refrigerant limits, interval metering, and a bar on on-site fossil-fuel combustion as a primary energy source for the larger tiers [ny-9nycrr-125-1]. How electricity choice works here
New York opened electric and gas supply to competition in the late 1990s under PSC Case 94-E-0952, and the retail access program runs under the Uniform Business Practices adopted in Case 98-M-1343 [ny-dps-esco-info]. The competitive sellers are called Energy Service Companies, or ESCOs, and the Department of Public Service publishes the list of ESCOs eligible to operate in each utility territory [ny-dps-esco-info]. Any customer of the six investor-owned electric utilities can buy supply from an eligible ESCO; the utility still owns the wires, responds to outages, and bills delivery [ny-dps-esco-info]. Long Island (PSEG Long Island / LIPA) and the municipal systems sit outside this framework [ny-dps-esco-info].
The wrinkle is the December 12, 2019 Reset Order in Case 15-M-0127. It limited what ESCOs may sell to mass-market customers, defined as residential and small non-residential accounts, to three product types: a savings-guarantee against the utility, products with at least 50 percent renewable content, or fixed prices no more than 5 percent above the trailing utility supply price [ny-psc-reset-order-2019]. Every ESCO that wanted to keep serving mass-market customers had to re-file its Retail Access Application [ny-psc-reset-order-2019]. The order does not restrict how larger commercial and industrial accounts contract, which is why a demand-metered grow or lab can still sign an index, block-and-index, or plain fixed contract [ny-psc-reset-order-2019]. Where exactly "small non-residential" ends is one of the open questions we flag on the switching guide.
If you never choose, you stay on utility supply. Con Edison and Orange & Rockland call the benchmark the Market Supply Charge; the other utilities post a monthly supply price [coned-rates]. Because that default price is built from NYISO day-ahead market results, it moves every month, and a fixed ESCO quote has to be judged against a moving target rather than a single posted number [coned-rates].
New York has its own grid operator. NYISO runs a single-state market with zonal locational-based marginal pricing for energy and a locational installed-capacity (ICAP) market that load-serving entities must buy into [nyiso-markets]. Capacity is priced separately for New York City (Zone J), Long Island (Zone K), and the lower Hudson Valley G-J locality, and those localities carry much higher capacity costs than the rest of the state [nyiso-markets]. Any supply contract you sign downstate must state whether capacity and transmission are fixed or passed through, because that line item can swing more than the energy price itself.

Read the 23.56 figure carefully. It is an all-in average across supply and delivery, dominated by Con Edison's New York City and Westchester load, where both delivery and NYISO Zone J capacity costs are the highest in the state [coned-rates]. A National Grid upstate facility in Buffalo or Syracuse buys energy and capacity in Zones A through F, where prices are far lower [ngrid-upstate-service-rates]. The 13-cent gap between the commercial and industrial averages is even wider than in most states, and it is mostly a story about delivery class, voltage, and location. A grow with a flat, well-managed load that lands in a large-general class upstate looks nothing like a Manhattan dispensary on a small-general class, even though both count as "commercial."

Climate and what it does to a grow's bill
New York's 1991-2020 normals are 6,001 heating degree days and 618 cooling degree days per year [noaa-cag-new-york]. That statewide average hides a real split. An indoor grow in the North Country spends most of the year rejecting lighting heat into cold outdoor air, which makes economizer cooling and heat recovery worth more than in a warm state. A downstate or Hudson Valley facility carries more summer latent load, because dew points in the 60s F are routine from June through September [noaa-cag-new-york]. Incentives worth knowing
- Con Edison's Commercial and Industrial Energy Efficiency Program pays rebates for lighting and controls, HVAC, motors, variable frequency drives, chillers, and refrigeration, plus a Custom track for anything not on the list. Incentives are capped at 50 percent of project cost with per-project maximums, and every project must be pre-approved before installation [coned-ci-program].
- National Grid upstate runs Large Business, Agriculture, and demand response programs; the Agriculture program offers incentives and grants for equipment upgrades and facility expansions, and demand response pays customers to curtail load [ngrid-upstate-ee].
- NYSERDA's FlexTech cost-shares energy studies that identify lighting, HVAC, and process opportunities, and NYSERDA points customers to utility programs for equipment rebates including custom horticultural measures [nyserda-lighting].
- NY-Sun provides upfront incentives, financing, and approved contractors for on-site commercial solar, layered with federal tax credits [nyserda-ny-sun]. See on-site solar and storage for how a grow's flat load changes the payback math.
Federal tax credits change with the tax code and with your entity's tax position, and cannabis businesses face 280E limits on deductions. Confirm treatment with your tax advisor before counting a credit in a payback estimate.
Quirks that make New York different
Compliance clocks run on the license tier. Tier 3 to 5 cultivators and Registered Organizations must hit 2.2 micromoles per joule at the lamp by their first renewal; nurseries, Tier 1 and 2, cooperatives, and microbusinesses have until their second renewal to hit 1.7 [ny-9nycrr-125-1]. Size the electrical design to the tier you expect to hold, not the one you start with [ny-9nycrr-120-3].
Interval meters are mandatory for indoor and mixed-light growers [ny-9nycrr-125-1]. That is a compliance cost, but it is also the data you need to negotiate a supply contract and to prove your load shape to an ESCO.
PowerScore is gone; the reporting duty is not. OCM sunset the PowerScore platform on September 4, 2026 after an August 31 deadline for anyone licensed to cultivate on or before December 31, 2025 [ny-ocm-sustainability]. Late licensees attest that they will report within 30 days of a replacement platform becoming available [ny-ocm-sustainability]. Monthly tracking of energy, water, on-site generation, and waste under 9 NYCRR 123.4(g) continues regardless [ny-9nycrr-125-1].
Capacity is a location cost. Downstate ICAP in Zones J and K and the G-J locality is a large piece of the supply bill [nyiso-markets]. Two facilities with identical loads, one in the Bronx and one in Utica, will get very different quotes, and the difference is mostly capacity and delivery, not energy.
Two Avangrid utilities share a rate plan. NYSEG and RG&E file joint rate cases, so a change in one tends to show up in the other. Their class thresholds and per-kW charges are the items we could not confirm from the current rate summary; treat any number you see quoted for them as unverified until you open the summary yourself.

Frequently asked questions
Can a New York cannabis license holder pick its own electricity supplier?
Yes, if the facility is served by Con Edison, Orange & Rockland, National Grid upstate, NYSEG, RG&E, or Central Hudson. Those six investor-owned utilities are open to PSC-eligible ESCOs and the utility keeps delivering the power. Long Island facilities on PSEG Long Island and customers of municipal systems are outside the retail access framework, so a Suffolk County grow cannot shop.
Does the 2019 ESCO Reset Order stop my facility from signing a fixed-price contract?
Generally no for a demand-metered commercial account. The order restricts the products ESCOs may sell to mass-market customers, meaning residential and small non-residential accounts, to guaranteed-savings, at least 50 percent renewable, or fixed prices within 5 percent of the trailing utility price. Larger commercial and industrial accounts can still sign index, block-and-index, or ordinary fixed contracts. A very small dispensary on a non-demand class should confirm with its ESCO which side of the line it falls on.
Why is New York commercial electricity so much more expensive than the U.S. average?
EIA's June 2026 commercial average for New York is 23.56 cents per kWh against a national average of 14.19. The statewide figure is pulled up by Con Edison's New York City and Westchester territory, where delivery and NYISO capacity costs are the highest in the state. An upstate National Grid or NYSEG facility in Zones A through F sees a much lower number. The industrial average of 10.17 cents shows how much the delivery class and location matter.
What energy rules does OCM impose on cultivators?
Under 9 NYCRR 125.1, horticultural lighting must reach at least 2.2 micromoles per joule for Tier 3 to 5 cultivators and Registered Organizations by first renewal, and 1.7 for nurseries, Tier 1 and 2, cooperatives, and microbusinesses by second renewal. Dehumidification, refrigerant GWP, and interval metering rules also apply, and larger tiers cannot use on-site fossil combustion as a primary energy source. Monthly resource tracking and annual reporting to OCM are required under 9 NYCRR 123.4.
What happened to PowerScore reporting?
OCM required annual resource benchmarking through PowerScore, due August 31, 2026 for anyone licensed to cultivate on or before December 31, 2025, and then sunset the platform on September 4, 2026. Licensees that missed the deadline attest that they will report within 30 days of a replacement platform becoming available.
